Immigration told not to allow Italian envoy Mancini to leave India

An alert has been sent to all airports and immigration outposts not to allow Italian ambassador Daniele Mancini to leave India under any circumstances, reported CNN-IBN.The alert is in compliance with a Supreme Court order passed on Thursday taking exception to the Italian government’s refusal to send back the two marines charged with the killing of two Indian fishermen, said the channel.[caption id="attachment_662688" align="alignleft" width="380"] AFP[/caption]A bench headed by Chief Justice Altamas Kabir also issued notice to the two marines, Massimiliano Lattore and Salvatore Girone, who were allowed by the apex court to go to Italy to cast their vote in the elections there after Italian Ambassador Daniele Mancini had given an assurance that they would be sent back.Attorney General (AG) G E Vahanvati brought the issue before the bench, saying that “its a breach of undertaking given to the highest court of the land and the government is extremely concerned about it”.After hearing the AG’s submission, the bench issued notices to the Ambassador and the two marines and asked them to file their response by 18 March.Subhash C Kashyap, an expert in constitutional law and former secretary general of the Lok Sabha, told Firstpost that while Mancini stands a real chance of being declared persona non-grata and asked to leave the country, he can be tried for contempt of court if the Supreme Court so desires.“When an ambassador gives a guarantee, it means the Italian government is giving an undertaking. And since he has voluntarily given a guarantee for the two Marines, the Supreme Court can take it up as a matter of contempt of court and decide whether in such a case he is allowed the benefit of the diplomatic immunity provision or not,” Kashyap said.With inputs from PTI
